Terms of Service
Acceptance of Terms
By downloading, installing, or using Volans (the "App") or visiting getvolans.app (the "Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App or Website.
These Terms constitute a legally binding agreement between you and Tomita Militaru ("we", "us", or "our"), the individual developer and operator of Volans.
Description of Service
Volans is a native macOS application that provides a graphical interface for managing deployments on the Railway platform. The App communicates with Railway's public API on your behalf using credentials you supply.
Volans is offered free of charge with all features included.
We reserve the right to modify, suspend, or discontinue any part of the service at any time without prior notice.
License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, solely for your personal or internal business purposes.
Restrictions
You agree not to:
- Copy, modify, distribute, sell, or lease any part of the App or its source code.
- Reverse-engineer, decompile, or disassemble the App, except to the extent expressly permitted by applicable law.
- Use the App to violate any applicable law or regulation, or Railway's own terms of service.
- Attempt to gain unauthorized access to Railway's API or any related systems through the App.
- Remove, alter, or obscure any proprietary notices within the App or Website.
- Use automated scripts or bots to interact with the Website.
Third-Party Services
Volans integrates with Railway's API. Your use of Railway is governed by Railway's own Terms of Service. We are not affiliated with, endorsed by, or sponsored by Railway.
The Website may contain links to external sites. We have no control over, and assume no responsibility for, the content or practices of any third-party websites.
Privacy
Your use of Volans is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our data practices.
Your Railway API token is stored exclusively in the macOS Keychain on your device and is never transmitted to our servers.
Disclaimer of Warranties
The App and Website are provided "as is" and "as available", without warranty of any kind. To the fullest extent permitted by law, Tomita Militaru expressly disclaims all warranties, whether express, implied, or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the App will be error-free, uninterrupted, or free of harmful components, or that defects will be corrected. We do not guarantee the accuracy or reliability of any results obtained through the App.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Tomita Militaru be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, loss of goodwill, or service interruption — arising out of or relating to your use of or inability to use the App or Website, even if advised of the possibility of such damages.
In no event shall our total cumulative liability to you for all claims arising out of or relating to these Terms or the App exceed USD $10.
Indemnification
You agree to indemnify, defend, and hold harmless Tomita Militaru from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the App or Website; (b) your violation of these Terms; or (c) your violation of any third-party rights, including Railway's terms of service.
Termination
We may suspend or terminate your license immediately, without prior notice or liability, if you breach any provision of these Terms. Upon termination, your right to use the App ceases immediately.
Sections 4, 8, 9, 10, and 13 survive termination of these Terms.
Changes to Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be communicated via the Website or via an in-app notice.
Your continued use of the App or Website after any changes constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.
Governing Law
These Terms are governed by and construed in accordance with the laws of Romania, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Romania.
If you are a consumer in the European Union, you may also be entitled to the mandatory consumer protection provisions of your country of residence.
